{"id":834,"date":"2020-08-11T10:19:13","date_gmt":"2020-08-11T08:19:13","guid":{"rendered":"https:\/\/klodzinskikancelaria.pl\/?p=834"},"modified":"2026-07-21T11:12:49","modified_gmt":"2026-07-21T11:12:49","slug":"czy-mozna-udostepnic-zakupione-ebooki-rodzinie-i-znajomym","status":"publish","type":"post","link":"https:\/\/klodzinskikancelaria.pl\/en\/is-it-possible-to-share-purchased-e-books-with-family-and-friends\/","title":{"rendered":"Can I share purchased e-books with family and friends?"},"content":{"rendered":" \r\n\r\n \r\n\r\n\r\n\r\nFor several years now, electronic versions of so-called books have become increasingly popular. e-books, especially now, during the coronavirus pandemic, when leaving home increases the risk of infection and libraries are often closed or their use is limited. The e-book market has increased by several dozen percent, to the delight of modern online bookstores and the great sadness of traditional ones. Reading books in any form as an activity for personal development should be strongly supported.\r\nAfter reading such an electronic book, can we not only recommend it, but also lend it to friends or family?\u00a0 <\/b>(After all, we want our loved ones to be able to spend their free time safely, enjoyably and productively!)\r\n\r\n\r\n\r\n\r\n\r\nTo answer this question, we must first consider two concepts set out in the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws 1994 No. 24, item 83, hereinafter: \u2018the Copyright Act\u2019). The first of these is the so-called exhaustion of rights, as set out in Article 51(3) of the Copyright Act, according to which, upon a copy of a work being placed on the market, the author loses the right to consent to its further placing on the market, with the exception, however, of hire and lending. Lending, on the other hand, is defined in Article 6(1)(8) of the Copyright Act as the transfer of a copy for temporary, gratuitous use \u2013 which is, in essence, equivalent to lending an e-book to family or friends. Consequently, in the situation under consideration, it will not be possible to invoke the doctrine of exhaustion. Furthermore, in a recent judgment, the Court of Justice of the European Union ruled that the sale of an e-book does not constitute public distribution or making a work available to the public, and that the principle of exhaustion of rights applies only to works in tangible form. Accordingly, in accordance with this judgement, the resale of an e-book requires the consent of the holder of the economic copyright, as the right is not exhausted.\r\n\r\n\r\n\r\n\r\n\r\nThe second concept is that of \u2018fair use for personal purposes\u2019, which is regulated in Article 23 of the Act. The essence of permitted use boils down to the fact that, in the view of both national and EU legislators, it is necessary, to a certain extent, to allow persons other than those authorised under a licence to use a work. This is justified in two ways \u2013 firstly, the aim is to avoid creating a \u2018dead letter\u2019 in the law that would be impossible to apply in normal human interactions \u2013 this is therefore a pragmatic approach.\u00a0 Secondly, there is an economic justification, the aim of which is to limit the potential monopoly of the creator. In accordance with Article 23(2) of the Copyright Act, \u2018the scope of personal use covers the use of individual copies of works by a circle of persons with a personal relationship, in particular kinship, affinity or a social relationship\u2019.\r\n\r\nTherefore, if we lend our e-book to members of our family or close friends, this does not constitute an infringement of the work\u2019s copyright. The question arises as to whether, in such a situation, it is possible to make several copies of the work for personal use and pass them on to family and close friends?\u00a0 The regulations in this regard are not entirely clear, as the legislator has been unable to keep pace with technological changes. Opponents of such an arrangement point out that a work may only be made available together with the medium on which it is stored, which is usually an e-reader.\r\n\r\nHowever, the prevailing view is that this is permitted, as this is the essence of permitted personal use, and the application of this provision is based, amongst other things, precisely on the creation of copies, such as of a paper book. In this regard, one can refer to the wording of the Act itself, which uses the term \u2018copies of a work\u2019, thereby permitting the plural form. Other digital files, such as music files, are treated in a similar manner.\r\n\r\nFurthermore, this is also justified by the wording of Article 231<\/sup>which allows for the temporary and incidental multiplication of a work, without independent economic significance, which is necessary for the lawful use of the work. It is worth noting, however, that such an argument is questionable, as the purpose of introducing this provision and its function are entirely different \u2013 it concerns the transfer of files between intermediaries, as well as the creation of backup or current copies by a program, in order to ensure the proper operation of a specific program. However, it should be remembered to maintain the actual personal relationship. The institution of fair use is, after all, an exception to the general rules, and therefore will have to be interpreted narrowly, or even very narrowly. The legality of such an action should be treated more as an exception to the rule of punishability, rather than a right that we can freely use by distributing the file to dozens of people.\n\nIt is worth highlighting one more important issue at this point \u2013 personal fair use has been excluded in relation to computer programs in accordance with Article 77(1). The question then arises whether such an exclusion will not have an impact on the issue of e-books, which remain in electronic form. The answer, however, seems very simple \u2013 of course not. Doctrine and case law have already developed the concept of a computer program, which is not defined by statute. This took place in two judgments of the ECJ C-393\/09 and C-406\/10, according to which a computer program exists only in the form of source code, object code and technical documentation \u2013 a file with a book is therefore still a book, simply in electronic form. It cannot be considered a computer program in any way.\r\n\r\n\r\n\r\n\r\n\r\nTo sum up - as a rule, we can share our e-books with family and closest friends, provided, however, that it is actually the circle of people closest to us and provided that we are absolutely sure that none of these people will share it further in another form - e.g. publicly on a downloadable website or in torrents.<\/b> In such a case, the work would be illegally reproduced and the license would be violated. When sharing our e-book with family or closest friends, we can create a copy of the file - if possible without breaking any security, but such copies cannot be distributed by anyone or made available to more people.\r\n\r\n\n\n
