The handover takes place in the presence of the buyer, who can attend themselves or with a professional assessing the condition of the building unit. In the case of a self-guided collection, this should be done in daylight and with items such as a spirit level, a square, a voltage tester, the contract and the project.<\/p>\n<p>The buyer should check, among other things, the surface area, quality of materials, layout of installations, electricity, window seals, scratches on panes, and correct drainage on the balcony.<\/p>\n<h2 id=\"zglaszanie-wad\">2. Reporting defects to the minutes<\/h2>\n<p>Failure to report defects in the minutes creates a presumption that the property was handed over without any issues. If defects are recorded in the minutes, the developer has 14 days to respond and 30 days to rectify the defect (they must justify any delays). If they do not acknowledge the defects, the next recourse is legal action and assistance. <strong><a href=\"https:\/\/klodzinskikancelaria.pl\/en\/\">law firm<\/a><\/strong>.<\/p>\n<h2 id=\"odmowa-odbioru\">3. What can you demand under the warranty for defects?<\/h2>\n<p>The buyer may demand (while observing the principle of proportionality):<\/p>\n<ol>\n<li>removal or rectification of the defect,<\/li>\n<li>a reduction in the price of the flat<\/li>\n<li>withdrawal from the contract and refund (in case of significant defects).<\/li>\n<\/ol>\n<h2 id=\"jakie-wady\">6. What defects in the premises can be reported under the warranty?<\/h2>\n<p>The warranty law applies when the property (Art. 556<sup>1<\/sup> k.c.):<\/p>\n<ul>\n<li>There are no properties it ought to have (for example, the windows are glaringly leaky),<\/li>\n<li>there are no properties that the seller assured (e.g. a lack of sound insulation, different sun exposure or view),<\/li>\n<li>unsuitable for its purpose (e.g. being a residential property instead of a restaurant),<\/li>\n<li>was released in an incomplete state.<\/li>\n<\/ul>\n<h2 id=\"odpowiedzialnosc\">7. The developer&#039;s liability for defects in the premises under warranty<\/h2>\n<p>The developer is liable on a risk basis \u2013 they do not need to be aware of the defect. The buyer-consumer who discovers a defect within the first year of the property's handover benefits from a presumption that the defect (or its cause) existed at the time the risk passed (handover), and it is the developer who must prove otherwise.<\/p>\n<h2 id=\"gwarancja\">8. Are warranty and guarantee the same thing?<\/h2>\n<p>No. Statutory warranty is liability by law, and a guarantee is a voluntary commitment by the developer set out in the contract (it often offers less protection). The buyer decides which right they are exercising. The statutory warranty is usually more advantageous.<\/p>\n<h2 id=\"czas-rekojmi\">9. Additional compensation from the developer<\/h2>\n<p>In addition to the warranty, the buyer may in some cases claim compensation (statute of limitations: 6 years) for damage to property caused by a defect in the flat.
