NFZ twierdzi\u0142, \u017ce technicy ci nie byli do sprzeda\u017cy takich produkt\u00f3w uprawnieni. Z takim stanowiskiem nie zgodzili si\u0119 nasi Klienci, a S\u0105d podzieli\u0142 nasz\u0105 argumentacj\u0119 i zas\u0105dzi\u0142 od NFZ \u015brodki, kt\u00f3re bezzasadnie nie zosta\u0142y wyp\u0142acone aptekom.<\/p>\n<h2 id=\"stan-faktyczny\">The facts of the cases - why did the NHF impose penalties on pharmacies?<\/h2>\n<p>The facts of both cases were similar, medicines containing very potent substances were dispensed by pharmacy technicians employed in pharmacies. The National Health Fund, after conducting inspections in pharmacies, tried to prove that they were not authorised to do so. The dispute concerned the legal interpretation of Article 91 of the Act <a href=\"https:\/\/isap.sejm.gov.pl\/isap.nsf\/DocDetails.xsp?id=wdu20011261381\">Pharmaceutical law<\/a>, according to which:<\/p>\n<p><strong>Art. 91. 1.<\/strong> A pharmacy technician with two years of full-time practice in a pharmacy may perform professional activities in a pharmacy involving the preparation, manufacture, dispensing of medicinal products and medical devices, with the exception of medicinal products having in their composition:<br \/>\n1) substancje bardzo silnie dzia\u0142aj\u0105ce okre\u015blone w Urz\u0119dowym Wykazie Produkt\u00f3w Leczniczych dopuszczonych do obrotu na terytorium Rzeczypospolitej Polskiej,<br \/>\n2) substancje odurzaj\u0105ce,<br \/>\n3) substancje psychotropowe grupy I-P oraz II-P<br \/>\n- specified in separate regulations.<\/p>\n<h2 id=\"motywy\">Key reasons for the court's favourable decision for pharmacies<\/h2>\n<h3>The provision of Article 91(1) <a href=\"https:\/\/isap.sejm.gov.pl\/isap.nsf\/DocDetails.xsp?id=wdu20011261381\">Pharmaceutical Law<\/a> nie odnosi si\u0119 do Farmakopei Polskiej i zawartego tam wykazu \u201eA\u201d<\/h3>\n<p>The Court shared our view that Article 91(1) refers, inter alia, to the Official List of Medicinal Products Authorised for Marketing in the Republic of Poland (UWPL), which does not contain a list of very potent substances.<\/p>\n<p>S\u0105d zaznaczy\u0142, \u017ce cho\u0107 ten przepis prawa farmaceutycznego odwo\u0142uje si\u0119 tak\u017ce do \u201eodr\u0119bnych przepis\u00f3w\u201d, to jednak Farmakopea Polska nie stanowi \u017ar\u00f3d\u0142a prawa w rozumieniu art. 87 Konstytucji Rzeczypospolitej Polskiej, lecz jest jedynie wydawnictwem urz\u0119dowym zawieraj\u0105cym normy techniczne i jako\u015bciowe. Tym samym nie mo\u017cna twierdzi\u0107, aby Farmakopea by\u0142a \u201eodr\u0119bnym przepisem\u201d w rozumieniu ww. regulacji i w konsekwencji nie mo\u017cna na jej podstawie ogranicza\u0107 praw technik\u00f3w farmaceutycznych.<\/p>\n<h3 id=\"nie-jest-ustawodawca\">Neither the NFZ nor the Court can replace the legislator<\/h3>\n<p>The court also emphasised that the legislator had long been aware of the imprecise regulations of the pharmaceutical law and the need to amend them, but had not taken the necessary legislative steps in this direction until the date of the NFZ inspection of pharmacies.<\/p>\n<p>The adjudicating panel noted that the defect in Article 91(1)(1) of the Pharmaceutical Law is a failure of the legislator, which the Court cannot rectify by way of a ruling, as it is not allowed to substitute the legislator in this respect. The amendment of the law belongs to the powers of the legislature, and neither the NFZ nor the judicial authority has the right to step into such a role by making an expansive interpretation of the aforementioned provision. Until the law is amended, pharmacies should not be penalised.<\/p>\n<h3 id=\"wykladnia-zawezajaca\">Article 91(1)(1) of the Pharmaceutical Law must be interpreted restrictively<\/h3>\n<p>In the oral recitals of the decision, the Court noted that Article 91 of the Pharmaceutical Law limits the competence of a pharmacy technician. However, its nature in accordance with the principles of correct legislation means that the interpretation of this provision should be restrictive. Thus, there is no basis for \"supplementing\" the aforementioned provision by referring to the Polish Pharmacopoeia. Where the legislator wished to refer to the above-mentioned official publication, it did so explicitly. Such an explicit reference, in turn, is lacking in the above-cited Article 91 of the Pharmaceutical Law.<\/p>\n<p>Thus, the court acknowledged our arguments and awarded our clients payment of outstanding funds that had previously been unjustifiably deducted by the National Health Fund. They will therefore recover their money.<\/p>\n<h2 id=\"znaczenie\">What do today's rulings mean for pharmacies, their owners, pharmacists and pharmacy technicians?<\/h2>\n<p>Opisywane wyroki stanowi\u0105 potwierdzenie linii orzeczniczej S\u0105du Najwy\u017cszego, z kt\u00f3rej wynika, \u017ce rol\u0105 NFZ w toku czynno\u015bci kontrolnych jest dba\u0142o\u015b\u0107 o wydatkowanie \u015brodk\u00f3w publicznych i szczelno\u015b\u0107 systemu refundacyjnego. Nie jest ni\u0105 natomiast pe\u0142nienie roli \u201ez\u0142ego policjanta\u201d, kt\u00f3ry karze aptekarzy niezale\u017cnie od wagi uchybienia oraz niezale\u017cnie od tego, czy produkt leczniczy trafi\u0142 do osoby uprawnionej zgodnie z ordynacj\u0105 lekarsk\u0105.<\/p>\n<p>Today's win is another step in our mission to effectively protect the rights of pharmacy workers.
