The Supreme Court stated that the loss of ownership of a thing as a result of adverse possession does not extinguish the former owner's claim for compensation for the use of the thing during the period preceding the expiry of the adverse possession period. Adverse possession of a property, which is key to the case, concerns a situation where, as a result of the passage of time, the possessor of a property may, under certain conditions, acquire its ownership through long-term and actual full possession. As was clearly emphasised in this Supreme Court ruling, in such a situation, the person who lost the property due to adverse possession has the right to demand rent payment. <strong>How does the resolution affect the legal situation of the existing properties?<\/strong> This resolution was adopted by seven judges of the Supreme Court. In accordance with the content of Article 87 \u00a7 1 of the Act on the Supreme Court, a panel of 7 judges may decide to give the resolution the force of a legal principle. Currently, the Supreme Court's portal lacks any annotation stating that the Court has decided to give this resolution the force of a legal principle. Therefore, the presented position is not absolutely legally binding for other courts. However, due to the status of the Supreme Court, it will certainly be taken into account when adjudicating cases of acquisitive prescription by other courts. Specifically, when the former owner demands rent. Therefore, for former owners of movable property or real estate, there will certainly be an temptation to file a lawsuit against the new owners. These lawsuits will refer not only to the provisions of law concerning remuneration for the unauthorised use of real estate, but also precisely to this resolution of the Supreme Court. <strong>This means that people filing cases for the declaration of adverse possession will have to take into account that even if they win the declaration of adverse possession of the property, they will be sued by the former owners for the payment of rent.<\/strong> In turn, people defending the ownership of their real estate in adverse possession cases have gained quite a good way to defend themselves in such cases. <strong>Adverse possession \u2013 immovable property, movable property, duration of adverse possession<\/strong> In accordance with the provisions of the Civil Code, acquisitive prescription occurs when a person who is not the owner of a property acquires ownership by possessing it continuously for twenty years as the sole possessor, unless they obtained possession in bad faith \u2013 in which case ownership is acquired after thirty years. Acquisitive prescription of movable property is also possible \u2013 in this case, ownership is acquired after possessing the item continuously for three years as a possessor. However, if someone possesses a movable item in bad faith, they will never acquire its ownership through acquisitive prescription. Therefore, the key concepts must be clarified.<\/p>\n<h4 id=\"toc-2\">Who is an autonomous possessor?<\/h4>\n<p>An autonomous possessor is a person who actually possesses the thing as the owner, even if he obtained possession in an unlawful manner. This legal definition of spontaneous possession does not involve the concept of ownership - what is important is only the actual possession of a given thing or property and manifesting one&#039;s actions towards it as an owner. Possession of real estate in the context of adverse possession emphasizes the importance of continuous and open possession as a condition for obtaining a declaration of acquisition of ownership of real estate by adverse possession.<\/p>\n<h4 id=\"toc-3\">What is good faith as a condition for adverse possession of real estate?<\/h4>\n<p>The prerequisites for acquisition by prescription, including the role of good faith, are crucial for understanding how property can be acquired by prescription. Good faith is the justifiable ignorance of the true state of affairs, usually consisting of the existence of some legal relationship or right. The concept of good faith therefore comprises three elements: (1) the conviction that a right or legal relationship exists (or that it does not); (2) the erroneous nature of this conviction; and (3) the possibility of justifying the error in the given circumstances[[1]](LINK 1). This is therefore a case where a person possessing a certain item is unaware that someone else is its owner or assumes that the item is ownerless. Many factors can influence the adoption of such a conviction, for example: observing that no one appears on the given property; the neglected state of the property or item; finding the item in circumstances suggesting it has been abandoned. Of course, these circumstances must be sufficiently real and justifiable for one not to speak of possession in bad faith. Importantly, the interested party must exercise due diligence, meaning they must ascertain that their conviction regarding the given property or movable item is indeed as it is. Good faith is excluded by both positive knowledge of the lack of the conferred right and the lack of such knowledge resulting from a lack of due diligence, i.e., negligence[[2]](LINK 2).<\/p>\n<h4 id=\"toc-4\">What is possession in bad faith in adverse possession?<\/h4>\n<p>Not every property can be subject to prescription; for example, public goods are excluded, and prescription requires the fulfilment of specific criteria, such as possession in good faith and the presumption of independent possession. According to case law, possession is in bad faith when someone, invoking a right they claim to have, knows that this right does not belong to them, or when they are aware that a specific right does not belong to them, but their ignorance is not justified in light of the circumstances of the case [[3]]. Therefore, we speak of bad faith when someone knows or should know that someone else is the owner of a given property or movable asset. There can be many such cases \u2013 the simplest being when we use a given item knowing that someone else is its rightful owner. We also speak of bad faith when, for example, we notice that the appearance of a given item changes (e.g., a property has been renovated, new elements have appeared there) \u2013 this should raise justified doubts as to whether the item has been abandoned. Importantly, it is possible for possession in good faith to transform into possession in bad faith. If, during the prescription of ownership, we learn that someone else is the owner, the conditions for the prescription of property change: (1) in the case of real estate, the time after which it is possible to acquire ownership through prescription is extended to 30 years, while (2) in the case of movable assets <strong>adverse possession becomes impossible<\/strong>.<\/p>\n<h4 id=\"toc-5\">To sum up the issue of the duration of adverse possession - how many years does adverse possession last?<\/h4>\n<ul>\n<li>Real estate \u2013 in good faith 20 years.<\/li>\n<li>Real estate \u2013 bad faith 30 years.<\/li>\n<li>Movable property \u2013 in good faith, 3 years.<\/li>\n<li>Movable property \u2013 in bad faith it is impossible.<\/li>\n<\/ul>\n<h4 id=\"toc-6\">Importantly, the provisions of the Civil Code provide for the presumption of good faith.<\/h4>\n<p>This presumption is rebuttable - it means that unless it is adequately proven that the holder possessed a given thing or property in bad faith, it is considered that he did so in good faith. This is definitely an advantage for the sole proprietor, but it does not prevent the owner from asserting his rights. There are also court judgments with the force of a legal principle, which determine in advance who is in good faith and who is in bad faith and in what situation. To help determine this, please visit <a href=\"https:\/\/klodzinskikancelaria.pl\/en\/online-booking\/\" rel=\"noopener noreferrer\">consultation.<\/a><\/p>\n<h4 id=\"toc-7\">What is the property owner&#039;s claim for remuneration for non-contractual use?<\/h4>\n<p>The provisions of the Civil Code provide for rights in favour of the owner of a thing in the event of its use by a person who is not authorised in any way (a de facto owner) \u2013 of course, this problem has been resolved differently in the case of a de facto owner acting in bad faith or good faith. We will first discuss the situation of a de facto owner acting in good faith: <strong>Article 224 of the Civil Code<\/strong><\/p>\n<ul>\n<li><strong>1.\u00a0<\/strong>An independent possessor in good faith is not obliged to pay for the use of the thing and is not responsible for its wear and tear, or for its deterioration or loss. He acquires ownership of natural benefits that have been separated from the thing during his possession, and retains the civil benefits collected if they have become due at that time.<\/li>\n<li><strong>2.\u00a0<\/strong>However, from the moment the independent possessor in good faith learns that an action for the delivery of the thing has been brought against him, he is obliged to pay for the use of the thing and is liable for its wear, deterioration or loss, unless the deterioration or loss occurred without his guilt. He is obliged to return the benefits collected from the above-mentioned moment and which he has not used, as well as pay the value of those which he has used.<\/li>\n<\/ul>\n<p>In light of the resolution adopted, for a bona fide possessor, this would mean that despite acquiring ownership of real estate or movable property through usucaption, the former owner could claim payment from them for the use of the property. The possessor may also be liable for the depreciation, deterioration, or loss of the property, unless these events occurred through no fault of their own. If the property (real estate or movable) generates benefits \u2013 the possessor would be obliged to return those benefits that they have not consumed, and for those consumed \u2013 to return their value. This issue appears problematic to the extent that, in the case of acquiring real estate through usucaption, these claims could reach a significant amount.<\/p>\n<h4><\/h4>\n<h4 id=\"toc-8\"><strong>When does the previous owner&#039;s right to the property lose?<\/strong><\/h4>\n<p>A resolution by seven Supreme Court judges states that the loss of property ownership due to adverse possession does not extinguish the former owner's claim for compensation for the use of the property during the period preceding the expiry of the adverse possession period. This is because, in the case of adverse possession, the acquisition of ownership by the possessor and its loss by the previous owner of the property occur <strong><em>ex lege<\/em> (by the power of law)<\/strong> on the date the limitation period expires. Consequently, an action for the recovery of immovable property brought after the acquisition of ownership by prescription should be dismissed on the grounds of the claim being unfounded, as the former owner no longer possesses ownership rights to the immovable or movable property. It would be possible to bring an action for payment of remuneration for the gratuitous use of the immovable or movable property, however, the plaintiff would then have to justify their claim based on the fact that they were once, during a specific period, the actual owner of the given object. However, would this not constitute excessive favouritism towards former owners of property acquired by prescription? This problem may not be as severe in the case of movable property, as in this instance, acquisition of ownership by prescription occurs after three years. Real doubts and considerable claim amounts usually arise in cases of acquisition of ownership of immovable property by prescription.<\/p>\n<h4 id=\"toc-9\">Doubts as to the deadline for the admissibility of claims for remuneration for the use of real estate subject to adverse possession<\/h4>\n<p>The use of real estate for 20 or 30 years may take the form of a claim for payment of an exorbitant amount. What if the interested party (owner) did not exercise his property rights intentionally, <em>de facto<\/em> abandoning a property? It is worth considering \u2013 and indeed very common \u2013 for a property owner to be residing outside of Poland, and for the property they own to be managed or supervised by no one. There is also a range of factual situations where owners registered in the relevant registers are deceased, but it is impossible to obtain information about living heirs. What happens if someone neglects to correct information in the registers, but then remembers they own such a property? In this case, it is possible to exercise one's (already expired) right and claim remuneration \u2013 despite the property's acquisition by prescription. In the case of a resolution passed regarding the property's acquisition by prescription, the justification has not yet been published \u2013 therefore, it is not possible to familiarise oneself with the considerations of the adjudicating panel in their entirety. Only by familiarising oneself with the legal analysis and conclusions drawn will it be possible to assess whether the position expressed is detailed and logical or not. The essence of acquisition by prescription is the legal acquisition of ownership of immovable or movable property due to the previous owner's failure to exercise their right. It should also be pointed out here that the acquisition of ownership by prescription is of a <strong>primary acquisition<\/strong> \u2013 Therefore, we assume fictionally, as if the party acquiring ownership were the first owner of the property. This means there is no legal connection to the previous owner \u2013 hence, as a general rule, all previous legal encumbrances on the property are extinguished from the moment of acquisition by prescription. Earlier, the issue of claims by the former owner of the property after the acquisition of ownership by prescription was addressed in 2016 by the Court of Appeal in Krakow: \"The function of acquisition by prescription is contrary to granting the former owner, against the possessor who has become the owner, any claims based on the right of ownership. Such claims would include supplementary claims for the period preceding the date of acquisition by prescription, including the claim for remuneration for the use of the property. The order, legal order, and stabilisation of relations concerning the ownership of property, i.e., everything that acquisition by prescription aims to ensure, would again be disrupted by disputes concerning the claim for remuneration for the use of the property in the period preceding the date of acquisition by prescription, which is primarily dependent on ownership issues. <strong>Granting the former owner such a claim against the possessor who became the owner would therefore be incompatible with the purpose of adverse possession.<\/strong>To fully address the Supreme Court's position, we must await the publication of the resolution's justification and familiarise ourselves with it. This will allow us to understand the judging panel's line of reasoning and assess whether, in comparison with the ruling of the Krakow Court of Appeal, there are any other sensible arguments that would favour granting former owners the right to claim payment for the unauthorised possession of property or assets.
